Bitmovin AI Terms and Conditions
By clicking "I Understand and Agree" or using Bitmovin Artificial Intelligence Features (“Bitmovin AI”), you ("Company") agree to the following terms, which supplement and amend the existing Bitmovin Master Services Agreement ("MSA") or Bitmovin Terms and Conditions ("Terms") as applicable. The terms of the MSA or Terms as applicable shall apply in full force and effect except as modified in these AI Terms and Conditions.
1.BITMOVIN AI
1.1Bitmovin AI. Provides AI-powered capabilities within Bitmovin Solution, including but not limited to data analytics, intelligent automation, agentic decisioning, AI-assisted workflows, Model Context Protocol servers, scene and content analysis, video playback optimization, content encoding, personalization, accessibility enhancement, and content generation or summarization. Bitmovin AI utilizes third-party technologies and APIs, including but not limited to Google Cloud, Amazon Web Services (AWS), Microsoft Azure, OpenAI, Alpic, and other AI frameworks (“Third-Party Providers”). Company acknowledges that such providers are independent of Bitmovin and that Bitmovin is not responsible for their acts, omissions, or service performance.
1.2Access and Use of Bitmovin AI. Company and its authorized users have a non-exclusive, non-sublicensable, non-transferable right to access and use Bitmovin AI while this Agreement is in effect. Company’s rights to access and use Bitmovin AI are further limited in accordance with the limitations on access and use of the Bitmovin software under the MSA or Terms. Company may access and use Bitmovin AI solely for Company’s business purposes. Certain Bitmovin AI (e.g. AI Scene Analysis) functionalities may incur additional charges. Pricing details can be found in the Encoding Calculation Methodology or other applicable pricing documentation.
1.3Company Data. In order for Company to utilize all Bitmovin AI features available Bitmovin shall utilize Company Data to enable the functioning of these features and improve the features over time. Bitmovin may not back up Company Data or other information entered into Bitmovin AI, and such Company Data or information may not be available for retrieval. Bitmovin will not permit third parties to use Company Data to improve or train their AI models.
1.4Nature of Artificial Intelligence. Bitmovin AI generates results (“AI Output”) based on algorithms, models, and data inputs (“AI Input”) provided by the Company. AI Output may be probabilistic, incomplete, or contain inaccuracies. Bitmovin AI is intended to assist human decision-making and not to replace human judgment.
1.5Company Responsibility. Company is solely responsible for verifying, validating, and approving any AI Output, including those produced by Agentic or autonomous AI functionalities, or any AI Output which is combined with other information sources (eg. LLMs). Company assumes all risk associated with reliance on AI Output or any automated actions generated by Bitmovin AI.
1.6Disclaimers. Bitmovin AI and all AI Output are provided “AS IS” and “AS AVAILABLE.” Bitmovin expressly disclaims all warranties, express, implied, statutory, or otherwise, including but not limited to warranties of accuracy, reliability, merchantability, non-infringement, or fitness for a particular purpose. Bitmovin makes no guarantee that AI Output will be correct, complete, lawful, or free of harmful content or errors. Company acknowledges that AI Output may reflect biases, inaccuracies, or unpredictable behavior inherent to AI systems.
1.7Autonomous and Agentic AI. Where Bitmovin AI performs autonomous actions, suggestions, or decisions, such actions are deemed to occur under Company’s control. Company shall implement appropriate oversight, approval, and review mechanisms before acting on or deploying any AI Output.
2.TERM AND TERMINATION
2.1Term. This Agreement shall commence on the Effective Date and shall continue until the earliest to occur of termination or expiration of Company’s existing MSA or Terms, or either party’s notice to the other of termination of this Agreement.
2.2Termination. Either party may terminate this Agreement upon written notice at any time and for any reason.
2.3Rights and Obligations Upon Expiration or Termination. Upon expiration or termination of these Terms and Conditions, Company’s right to access and use Bitmovin AI shall immediately terminate, Company and its authorized users shall immediately cease all use of Bitmovin AI.
